A Philippine court on Tuesday convicted a U.S. Marine of homicide in the killing of a transgender woman past year.

Branch 74 Judge Roline Ginez Jabalde also ordered Pemberton to indemnify the heirs of Laude P4.32 million for loss of earning capacity, P155,250 for funeral and burial expenses, P50,000 for civil damages, P50,000 for moral damages and P30,000 for exemplary damages.
Pemberton earlier alleged that another person was able to enter the room after he left, but the Olongapo City lower court said “there was insufficiency amount of genetic data” that could prove his defense.
The deal allows the United States military to use Philippine bases for storage of supplies for operations relating to maritime security.

“It would be extremely unfair for Pemberton to remain in US custody”, Laude’s sister, Marilou, told BuzzFeed News shortly before the verdict was announced.
Leftist activists have used the Pemberton case to attack the VFA and the close defence ties between the USA and its former colony, the Philippines.

A Philippine court yesterday sentenced an American soldier to six to 12 years in jail for the death last year of a Filipino transgender person.
Ms Laude’s mother, Julita, said she had hoped Pemberton would be found guilty of murder, which carries a heavier penalty. [Laude’s] life is not wasted.
A lawyer for the Laude family, Harry Roque, expressed outrage that the sentence was reduced on those grounds. The punishment, says Roque, is “very light given the heinousness of the crime”.
The marine was on leave in Olongapo on 11 October 2014, after joint military exercises with the Philippine army, when he met Ms Laude – previously known as Jeffrey – in a bar. The two found a hotel to check into and began to have sexual relations.
A fellow Marine testified that Pemberton admitted killing a “he-she”, referring to Laude, upon his return to their ship, the USS Peleliu, then docked at the Subic port.
Chuck Little, a spokesman for U.S. Marine Corps Forces, Pacific, said Pemberton will remain at Camp Aguinaldo. Laude has a German boyfriend whom she was supposed to marry and knew she was a transgender woman.
During the case, lawyers for Pemberton argued that he didn’t kill Laude, while admitting that he did strangle her to the point of unconsciousness.
He claimed that Laude was still alive when he left the room, but prosecutors believe she drowned in a toilet. About 100 riot police cordoned off streets around the courthouse in Olongapo, about 80 miles from Manila, as about 200 protesters awaited the judge’s decision on where to house Pemberton. This is not quite a victory.
The crowd had dispersed by the time the standoff was over.
The U.S. had military bases in the Philippines until 1991, when the Philippine Senate ended their leases.
“We are very angry that the court considered these mitigating circumstances”, he said.

The debate has been triggered by a dispute over where Pemberton should serve his sentence.
