Why This Attorney Supports Independent Prosecutors For Police-Involved Crimes
Cuyahoga County prosecutor Tim McGinty described a “perfect storm of human error, mistakes and communications by all involved that day” – and said evidence considered by the grand jury “did not indicate criminal conduct by police”. “Our streets”. Officers blocked them from entering a divided highway and they sat down, blocking a major intersection.

Outside The Q at Huron and Ontario, Cleveland Police officers were joined by Cuyahoga County deputies who warned of potential arrests. Officers earlier stopped the protesters from marching onto the West Shoreway, a major traffic artery in and out of downtown.
The city issued a $3 million payout to both families just days before Rice’s death in 2014, and the case sparked the federal consent decree that residents now hope will address the department’s failures. Federal prosecutors are looking into possible civil rights charges against Timothy Loehmann and his partner.
The two officers are not allowed to return to patrol duties as the city conducts an internal review to determine if they should face administrative discipline.
Rice’s family says it is “in pain and devastated by the non-indictment of officers Timothy Loehmann and Frank Garmback for the murder of our beloved Tamir”.
Tamir’s family charged that McGinty improperly hired use of-force experts to tell the grand jury that Loehmann’s actions were reasonable.
The stereotypes of black males that may have inspired their fear, even subconsciously, were borne out of the institution of slavery which commodified blacks and later sought to villainize them as free people, scholars have said.
“I’m sad and I’m disheartened all at the same time”, said activist Laura Cowan, who participated in protests at the Cleveland park where Rice was shot.
“It should never happen again, and the city has taken steps so it doesn’t”, Mr McGinty said.
Kasich told reporters he’s frequently in touch with local officials and said, “I will only do what local people say that I need to do”, when asked whether he’ll go back to OH to prepare for protests.
The Ohio grand jury had heard weeks of testimony on the Rice shooting, which occurred within seconds after police reached a park next to a Cleveland recreation center in response to reports of a suspect with a gun.
“This was especially hard”, McGinty said.
“It’s fine for everybody to take a look at this, and clearly when you lose a 12-year-old, what more can you say about how tragic it is and imagine how the family feels”.
The two police officers cleared Monday of criminal charges in the fatal shooting of a 12-year-old black boy reacted based on what they knew at the time, that a “guy” was waving a gun and pointing it at people, their attorneys said Tuesday.
Following Adrine’s ruling, McGinty said publicly that the judge’s findings would not alter his office’s approach in presenting the case to a grand jury. But McGinty said there was no way for the officers on the scene to know that.
Rice was holding a replica of a.45-caliber handgun that fires plastic pellets and is sold with an orange tip on it. The gun Rice held did not have an orange tip.
“It is likely that Tamir, whose size made him look much older and who had been warned his pellet gun might get him into trouble that day, either meant to hand it over to the officers or show them it wasn’t a real gun”, McGinty, the prosecutor, said Monday.
