Wrongful Death Lawsuit Filed against Tony Stewart

Drivers with at least one win and in the top 30 in points are virtually assured of a spot in the field of 16.

News of the suit came as Stewart was practising at Watkins Glen worldwide for Sunday’s NASCAR Sprint Cup CHEEZ-IT 355.

Despite sitting 10th in the Sprint Cup point standings, he’s yet to post victory in the first 21 races of 2015.

“There are no guarantees unless you get that win”.

“What’ll really be interesting is to see how the drivers react to it for next year because all the information they had this year, what lines to take, that’s going to go out the window, so it’s going to be a real scramble next year here in the practice for those guys”, Kevin Twitchell said.

So far, Gordon has had four wins at the historic upstate New York road course – the Bud at The Glen in 1997 and 1998, the Frontier at The Glen in 1999, and the Global at The Glen race in 2001. Stewart drove by and the right tire of his vehicle hit Ward, who would later die at the hospital.

The suit was filed by Ward’s parents in Lewis County Supreme Court and claims Stewart deliberately accelerated as he saw Ward walking down the track after an incident between the pair on the previous lap. “We can not comment on anything more due to pending litigation”. It was something that we really pursued heavily.

“Whether it’s pressure to make the Chase or win the race, it is no more pressure than what I add to myself”.

Gordon hasn’t won here since 2001 and has not triumphed at either road course NASCAR races at since a win at Sonoma in 2006.

Gordon realized early to gain an advantage over the competition, he had to bring his A-game to each and every track.

“Our son got out of his auto during caution while the race was suspended”. With Allmendinger and the likes of Kasey Kahne, five-time race victor Tony Stewart, Clint Bowyer, Greg Biffle, Kyle Larson and Sam Hornish Jr. winless this season, it could lead to some interesting racing Sunday.

The family of racing driver Kevin Ward, who was struck and killed by Tony Stewart during a race last year, filed a wrongful death lawsuit against the NASCAR driver on Friday.

Stewart is the only named defendant in the lawsuit which seeks unspecified monetary damages for the August 9, 2014 crash, the family’s attorney Mark Lanierm said. There was no comment from Stewart, who was with his crew in the garage before a final practice Friday afternoon.

A moment of silence is scheduled at Canandaigua on Saturday night, according to a track spokesman, as the Empire Super Sprints return to the track.

The lawsuit alleges that Stewart, a three-time champion of NASCAR’s Sprint Cup Series, wrongfully caused Ward’s death by acting with ‘wanton, reckless and malicious intent and negligence.’.

He’ll try to focus on ending that streak.
